The federal government intends to challenge a Utah judge’s decision that struck down a year-old ban on dietary supplements containing ephedra.

The U.S. Department of Justice on Monday filed a notice of appeal in the case, announcing its intention to ask the 10th U.S. Circuit Court of Appeals to reconsider the ruling.

In April, U.S. District Judge Tena Campbell ruled the Food and Drug Administration had failed to shoulder its burden of proof that the amphetamine-like herb is unsafe in low doses. The judge determined that in order to ban all supplements containing ephedra, the FDA must first determine that “any dose, no matter how small, presents a significant or unreasonable risk of illness or injury.”
